Yes. Crossing China’s border without going through a legal port of entry is a criminal offence where the circumstances are serious, and the people who arrange or drive the crossing are punished far more heavily than the person who crosses. China’s Criminal Law deals with these offences in a dedicated section on obstructing the administration of national borders.
The law: who is punished, and how hard
Article 322 (crossing the border yourself). Anyone who violates the exit-entry rules and illegally crosses the national border, in serious circumstances, faces fixed-term imprisonment of not more than one year, criminal detention or surveillance, plus a fine.
Article 318 (organizing). Organizing other people to illegally cross the border carries two to seven years’ imprisonment and a fine. The exposure rises to more than seven years or life imprisonment where, for example, you are the ringleader of a group, you organize repeated crossings or large numbers of people, the crossing causes serious injury or death, migrants are deprived of their personal liberty, inspection is resisted by violence or threats, or the illegal gains are huge.
Article 321 (transporting). Transporting others across the border illegally carries up to five years’ imprisonment, detention or surveillance plus a fine; five to ten years in aggravated cases; and more than seven years where the crossing causes serious injury or death, or where violence or threats are used to resist inspection.
Articles 319 and 320 (documents). Obtaining a passport or visa by deception for use in organizing illegal border crossings carries up to three years; providing or selling forged or altered exit-entry documents carries up to five years, and more than five years in serious cases.
What this means in practice
The migrant and the organizer are not treated the same. A first-time border crosser can still end up with a criminal record, while the broker faces years in prison. For a foreigner the criminal case is only half the story: under Article 35 of the Criminal Law a court may order deportation as a standalone or additional punishment, and under Article 81 of the Exit-Entry Administration Law a deported foreigner may not re-enter China for ten years. If the matter stays administrative, illegal residence or illegal employment can lead to removal ordered by the border authority, with a one-to-five year entry ban under Article 62 of the same law.
A quick scenario
Hypothetical. A worker from a neighbouring country pays a broker several thousand yuan to be taken across the border into Yunnan for a factory job. Border police stop the group. The broker is prosecuted under Article 318, where the base sentence is two to seven years; if he ran a group and earned large profits, his exposure is more than seven years. The worker may be prosecuted under Article 322 if the circumstances are serious, which means up to one year, and in either case faces deportation and a possible ten-year entry ban. Paying the broker does not make the worker a victim in the eyes of the criminal law.
Common questions
Q: Is crossing the border illegally a crime, or just an immigration violation?
A: It can be both. Article 322 of the Criminal Law makes serious illegal border crossing a crime punishable by up to one year, while border authorities can separately order removal and an entry ban.
Q: Who gets the harshest sentence?
A: Organizers under Article 318, with two to seven years as the base and more than seven years or life in aggravated cases. Transporters under Article 321 face up to five years, rising to more than seven years where the crossing causes death or injury.
Q: Can I be deported as well as imprisoned?
A: Yes. Article 35 of the Criminal Law allows deportation to be imposed on a foreigner either independently or on top of the prison sentence.
Q: How long is the re-entry ban?
A: Ten years where deportation is imposed under Article 81 of the Exit-Entry Administration Law; one to five years where removal is ordered under Article 62.
Q: Does paying an agent shift the blame to the agent?
A: No. The organizer is prosecuted separately and more severely, but your own act of crossing illegally is still assessed against Article 322.
